Terms of Use

The Theralinq Mobile App Terms govern your use of the app and require users to be at least 18 years old or to use the app under the supervision of a parent, guardian, or authorized clinical provider.  Users acknowledge that participation in any activities or exercises accessed through the app carries inherent risks, including the risk of personal injury, and agree that Theralinq assumes no responsibility or liability for any injuries, adverse outcomes, or damages arising from use or misuse of the app or its content. Users are solely responsible for consulting qualified healthcare providers before initiating any program or activity.

Theralinq Terms of Use

Effective Date: January 24, 2026

 

By accessing or using the Theralinq application (“Theralinq”), you agree to these Terms of Use (“Terms”). If you are using Theralinq on behalf of an organization, you represent that you are authorized to bind that organization.

1. No Medical or Clinical Services

Theralinq is a non-clinical software platform that provides administrative, educational, and workflow support tools. Theralinq does not provide medical, health, or clinical advice, diagnosis, or treatment, and does not establish a provider-patient relationship.

All clinical decisions, patient care, supervision, and compliance with applicable laws and professional standards are the sole responsibility of licensed providers and/or Clinic organizations.

2. Exercises & Content Disclaimer

Theralinq may offer educational content, tools, activities, or exercises through its library (“Exercises”). All Exercises are recommendations only and are not prescriptions, treatment plans, or medical advice.

Theralinq does not represent that any Exercise is appropriate for any specific child or individual. Users and caregivers must consult with the child’s medical or mental health providers before starting, modifying, or discontinuing any Exercise.

All decisions regarding appropriateness, supervision, and use of Exercises remain the responsibility of the user, caregiver, and treating providers.

3. Pediatric & Parental Acknowledgment

If you use Theralinq on behalf of a child, you represent that you are the child’s parent, legal guardian, or are otherwise authorized. You acknowledge that:

  • Theralinq does not provide treatment or emergency services
     

  • Exercises are recommendations only
     

  • You are responsible for consulting the child’s providers and supervising use
     

 

4. No Emergency Use

Theralinq is not designed for emergency situations. In case of a medical or general health emergency, contact emergency services or a licensed provider immediately.

5. Assumption of Risk

You voluntarily assume all risks associated with use of Theralinq, including risks of emotional distress, personal injury, or death, whether foreseeable or unforeseeable.

​

 

6. Limitation of Liability

To the maximum extent permitted by law, Theralinq and its affiliates shall not be liable for any damages arising from or related to use of the platform, including but not limited to:

  • Personal injury, bodily harm, emotional distress, or death
     

  • Clinical outcomes or treatment decisions
     

  • Reliance on Exercises or content
     

  • Acts or omissions of providers, clinics, caregivers, or third parties
     

If liability is found, Theralinq’s total aggregate liability shall not exceed the fees paid to Theralinq in the twelve (12) months preceding the claim.

7. Release & Waiver

You hereby release, waive, and discharge Theralinq from any and all claims arising out of use of the platform, including claims involving personal injury or death, except where prohibited by law.

​

 

8. Indemnification (Clinics & Organizations)

Organizations and Clinics agree to defend, indemnify, and hold harmless Theralinq from any claims, losses, liabilities, or expenses (including attorneys’ fees) arising from:

  • Patient care or clinical services
     

  • Alleged malpractice, negligence, or wrongful death
     

  • Use or misuse of Theralinq by staff or contractors
     

  • Violations of healthcare, privacy, or licensing laws
     

 

9. Privacy & Data

Theralinq does not own patient data and does not determine clinical use of such data.

10. Governing Law

These Terms are governed by applicable law, without regard to conflict-of-law principles.

​

By using the App, you acknowledge that you have read, understood, and agreed to these Terms of Use. If you do not agree with these Terms, please do not use the App.
