Theralinq Privacy Policy

1. Introduction

This Privacy Policy (“Policy”) describes how Theralinq, Inc. (“Theralinq,” “Company,” “we,” “us,” or “our”) collects, uses, discloses, and protects personal information in connection with the Theralinq website at www.theralinq.com (the “Website”) and the Theralinq mobile application (the “App,” and together with the Website, the “Services”). The Website provides general marketing and informational content about Theralinq and does not provide access to the Theralinq platform. The App facilitates secure communication between caregivers of children receiving physical therapy, occupational therapy, and speech-language pathology services and licensed physical therapists, occupational therapists, and speech-language pathologists, including the assignment and viewing of therapy exercise videos and the tracking of therapy-related progress.

This Policy applies to all users of the Services, including caregivers, physical therapists, occupational therapists, speech-language pathologists, and other authorized users. By accessing or using the Services, you acknowledge that you have read, understood, and agree to the practices described in this Policy. If you do not agree, please do not use the Services.

This Policy should be read in conjunction with the Theralinq Website Terms of Use and the Theralinq Mobile App End User License Agreement (“EULA”), which govern your use of the Website and App, respectively.

2. Information We Collect

We collect information in the following categories:

2.1 Information You Provide Directly

When you create an account, use the App, or otherwise interact with the Services, you may provide us with the following types of information:

Account and Profile Information. When you register for an account on the App, we collect your name, email address, alias or display name, account credentials (username and password), and your role (e.g., caregiver or therapist). Therapists may also be asked to provide professional license information and affiliated practice or clinic details.

Child Health-Related Information. As part of providing the App's core functionality, we collect limited health-related information about a child receiving therapy. At this time, the health data collected through the App is limited to: (a) a child's age (but not full date of birth); (b) developmental or therapy milestones reached; (c) therapy goals entered or shared through the platform by a caregiver or therapist; (d) questionnaire responses, including a child’s reported impairments; (e) physical characteristics or description; and (f) physical or mental disability. Information entered into the App should be limited to what is reasonably necessary for therapy support and care coordination.

Communications. When caregivers and therapists communicate through the App's messaging feature, we collect the content of those messages to facilitate the exchange. We may also collect information you provide when you contact us for support or submit inquiries through the Website.

User-Generated Content. You may submit feedback, comments, photos, and videos through the App (collectively, “User-Generated Content”). Please note that a parent, caregiver, or therapist may voluntarily include more information in free-text comment fields than is required by the App. You should exercise caution when submitting User-Generated Content and avoid disclosing more personal information than is reasonably necessary for therapy support and care coordination.

Therapy Exercise and Performance Data. When caregivers engage with therapy exercise videos assigned through the App, we may collect exercise scoring or performance data generated through App usage.

Subscription and Payment Information. If you purchase a subscription or make an in-app purchase through the App, your payment transaction is processed by the applicable platform provider—Apple (via the App Store) or Google (via Google Play)—and is subject to that provider's terms of service and privacy policy. Theralinq does not collect or store your credit card number, bank account details, or other full payment credentials. We may receive limited transaction data from the platform provider, including a transaction identifier, the subscription plan selected, purchase and renewal dates, subscription status (e.g., active, expired, or canceled), and the country or region associated with your account. Subscription management, including cancellation and renewal, is handled through the applicable platform provider's app store, not directly through the App.

2.2 Information Collected Automatically

When you access or use the Services, we may automatically collect certain information, including:

Device and Usage Information. We collect information about the device you use to access the Services, including device type, operating system and version, unique device identifiers, mobile network information, and browser type (for the Website). We also collect usage data such as pages or screens viewed, features accessed, session duration, and interaction patterns.

Log Data. Our servers automatically record information when you use the Services, including your Internet Protocol (“IP”) address, access times, referring URLs, and crash or error reports.

Cookies and Similar Technologies. The Website may use cookies, pixel tags, and similar tracking technologies to collect information about your browsing activity. You may manage your cookie preferences through your browser settings. The App does not use cookies but may use analogous mobile tracking technologies such as software development kits (“SDKs”) for analytics purposes. You may be able to limit certain automatic data collection through your mobile device’s operating system settings, such as resetting your advertising identifier or restricting ad tracking. Disabling certain permissions or settings may affect the functionality of the App.

Information We Do Not Collect. The App does not collect precise geolocation data (such as GPS coordinates), biometric information, photos, address book or calendar data, or audio or video files from your device.

2.3 Information from Third Parties

We may receive information about you from third parties, such as identity verification services, analytics providers, or healthcare providers who refer users to the platform. We treat such information in accordance with this Policy.

3. How We Use Your Information

We use the information we collect for the following purposes:

Providing and Improving the Services. We use your information to operate, maintain, and improve the Services, including facilitating communication between caregivers and therapists, delivering assigned therapy exercise videos, tracking therapy milestones and goals, and personalizing the user experience within the App.

Aggregate Analytics. We use exercise scoring and performance data in aggregated and de-identified form to identify patterns across similar presenting profiles and to develop or improve future exercise recommendations and content. This aggregate scoring data is not used to identify an individual child and is not treated as personal information for these purposes.

Automated Exercise Suggestions. If you complete an in-app questionnaire providing information such as a child’s age and reported impairments, we may process that information using automated tools to generate exercise suggestions. These suggestions are produced algorithmically and are not reviewed by a clinician before being presented to you. You may disregard any automated suggestion at any time, and you are solely responsible for verifying suitability with a qualified healthcare professional.

AI-Assisted Summaries. When a caregiver rates an exercise, we may use artificial intelligence tools to aggregate performance scores and summarize scoring data and subjective comments. These AI-assisted summaries are designed to help therapists understand a child’s progress or identify potential challenges. AI-assisted summaries are generated algorithmically and are not a substitute for professional clinical judgment.

Surveys and Feedback. We may use your information to administer surveys, solicit feedback, and evaluate user satisfaction with the Services.

Account Administration. We use your information to create and manage your account, authenticate your identity, and process account-related requests.

Communications. We use your contact information to send you service-related notices, respond to your inquiries, and, where permitted, provide updates about the Services. We may also send you email marketing communications about the Services; you may opt out of such communications at any time by following the unsubscribe instructions contained in the email or by contacting us as described in Section 8 below.

Safety, Security, and Compliance. We use your information to detect, investigate, and prevent fraudulent, unauthorized, or illegal activity; to enforce our Terms of Use and EULA; to comply with applicable legal obligations; to review User Content for compliance with our policies, including content moderation; and to protect the rights, property, and safety of Theralinq, our users, and the public.

Subscription Management. We use transaction and subscription data received from platform providers to verify your subscription status, manage your access to premium features within the App, process subscription-related inquiries, and maintain accurate records of your subscription history.

Legal Obligations. We may use your information as necessary to comply with applicable laws, regulations, legal processes, or enforceable governmental requests.

4. How We Share Your Information

We do not sell personal information. We may share your information in the following circumstances:

Between Caregivers and Therapists. The App is designed to facilitate communication and information sharing between caregivers and therapists. Information you share through the App's messaging and therapy tracking features will be accessible to the other party in the caregiver-therapist relationship as necessary for therapy coordination.

Service Providers. We share information with third-party service providers who perform services on our behalf, such as cloud hosting, data storage, analytics, email delivery, subscription management, and customer support. These providers are contractually obligated to use your information only to provide services to us and in a manner consistent with this Policy.

Legal and Regulatory Disclosures. We may disclose your information if required to do so by law or in response to valid legal process, including subpoenas, court orders, or government requests. We may also disclose information when we believe in good faith that disclosure is necessary to protect our rights, your safety, or the safety of others, or to investigate fraud or respond to a government request.

Business Transfers. In the event of a merger, acquisition, reorganization, bankruptcy, or other sale of all or a portion of our assets, your information may be transferred as part of that transaction. We will notify you of any such change in ownership or control of your personal information.

Platform Providers. The App is distributed through the Apple App Store and Google Play Store. When you download the App or make an in-app purchase or subscription payment, certain information—including transaction data, device identifiers, and account-level information—is collected and processed by Apple or Google in accordance with their respective terms of service and privacy policies. Theralinq may receive limited transaction and subscription data from these platform providers as described in Section 2.1 above. We encourage you to review the privacy policies of Apple and Google to understand their respective data practices.

With Your Consent. We may share your information for other purposes with your express consent.

5. Children's Privacy

Theralinq takes the privacy of children seriously. The App is designed for use by adult caregivers (who must be at least 18 years of age) and licensed physical therapists, occupational therapists, and speech-language pathologists, not by children directly. Children do not create accounts or directly interact with the App.

However, because the App collects limited health-related information about children in the course of facilitating therapy between caregivers and therapists, we are committed to compliance with the Children's Online Privacy Protection Act (“COPPA”) and applicable state laws governing children's data. The App may also collect information about children between the ages of 13 and 18, and such collection is subject to applicable state laws governing minors’ data, in addition to COPPA protections for children under 13.

Parental and Caregiver Role. All information about a child is entered into the App by the child's caregiver or by the child's therapist. By entering information about a child into the App, the caregiver represents and warrants that he or she is the child's parent or legal guardian, or has been authorized by the child's parent or legal guardian to provide such information and to consent to Theralinq's collection and use of the child's information as described in this Policy.

Limited Collection. We limit the collection of children's information to what is reasonably necessary for the App's therapy support and care coordination functions, as described in Section 2.1 above. Theralinq does not currently collect a child's full date of birth through the App.

Use and Disclosure. Children's information is used only for the purposes described in this Policy and is shared only as set forth in Section 4 above. We do not use children's information for advertising or marketing purposes.

Parental Rights. A parent or legal guardian may review the personal information we have collected about their child, request deletion of such information, or refuse to permit further collection or use of the child's information by contacting us at support@theralinq.com. If we learn that we have collected personal information from a child without appropriate parental consent, we will take steps to delete that information promptly.

6. Health Information and HIPAA

The App facilitates communication between caregivers and licensed physical therapists, occupational therapists, and speech-language pathologists and may involve the exchange of health-related information. Depending on the nature of the relationship between Theralinq and the healthcare providers using the platform, Theralinq may act as a Business Associate under the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”) and its implementing regulations. Where Theralinq acts as a Business Associate, it enters into Business Associate Agreements (“BAAs”) with applicable Covered Entities and handles Protected Health Information (“PHI”) in accordance with HIPAA requirements. The terms of any applicable BAA will govern in the event of a conflict between this Policy and the BAA with respect to PHI.

Theralinq is not a healthcare provider and does not provide medical advice, diagnosis, or treatment. The content available through the App, including therapy exercise videos and messaging functionality, is intended to support care coordination between caregivers and licensed therapists and does not constitute the practice of medicine, physical therapy, occupational therapy, or speech-language pathology by Theralinq.

7. Data Security

We implement administrative, technical, and physical safeguards designed to protect the personal information we collect. These measures include encryption of data in transit and at rest, access controls, secure authentication protocols, and regular security assessments. However, no method of transmission over the Internet or method of electronic storage is completely secure. While we strive to use commercially reasonable means to protect your personal information, we cannot guarantee its absolute security. You are responsible for maintaining the confidentiality of your account credentials and for notifying us promptly at info@theralinq.com of any unauthorized use of your account or any other security breach.

Data Processing Location. Your information may be processed and stored in the United States and in other jurisdictions where Theralinq or its service providers maintain facilities. If you access the Services from outside the United States, you consent to the transfer of your information to the United States, where data protection laws may differ from those in your jurisdiction.

8. Your Rights and Choices

Depending on your jurisdiction, you may have certain rights with respect to your personal information, including the following:

Access. You may request access to the personal information we hold about you.

Correction. You may request that we correct inaccurate or incomplete personal information.

Deletion. You may request that we delete your personal information, subject to certain exceptions (e.g., where retention is required by law or for legitimate business purposes).

Opt-Out of Communications. You may opt out of receiving non-essential communications from us by following the unsubscribe instructions in such communications or by contacting us at the address below.

Data Portability. Where applicable, you may request a copy of your personal information in a structured, commonly used, and machine-readable format.

To exercise any of these rights, please contact us at support@theralinq.com. We will respond to your request in accordance with applicable law. We may need to verify your identity before processing your request.

9. State-Specific Privacy Rights

9.1 California Residents

If you are a California resident, you may have additional rights under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (“CCPA/CPRA”). These include the right to know what personal information we collect, use, and disclose; the right to request deletion of your personal information; the right to correct inaccurate personal information; and the right to opt out of the sale or sharing of personal information. Theralinq does not sell or share (as those terms are defined under the CCPA/CPRA) your personal information. Under the CCPA/CPRA, personal information of consumers under 16 years of age is subject to additional protections; Theralinq does not sell the personal information of minors under 16. To exercise your rights under the CCPA/CPRA, please contact us at support@theralinq.com. You may also designate an authorized agent to submit a request on your behalf. We will not discriminate against you for exercising your privacy rights under the CCPA/CPRA.

9.2 Residents of Other States

Residents of other states with applicable consumer privacy laws (such as Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, and other states with enacted privacy legislation) may have similar rights, including the right to access, correct, delete, and obtain a copy of their personal information, as well as the right to opt out of certain processing activities. To exercise these rights, please contact us at support@theralinq.com. If we decline a privacy rights request, you may appeal our decision by contacting us at support@theralinq.com with the subject line “Privacy Rights Appeal.” We will respond to your appeal in accordance with applicable law.

10. Data Retention

We retain personal information for as long as your account remains active or as reasonably necessary to fulfill the purposes described in this Policy. Health-related data associated with a user account is retained for as long as the account remains active. If an account is closed or deleted voluntarily, Theralinq will delete or de-identify associated personal information within ninety (90) days, except to the extent that retention is required by applicable law, regulation, or legal obligation, or is necessary for the establishment, exercise, or defense of legal claims, or is maintained in routine backup archives from which deletion is not commercially practicable. In the event of involuntary account termination, Theralinq may retain data necessary for enforcement purposes for a period not to exceed three (3) years. We will provide notice to users if a longer retention period is required by law.

11. Third-Party Links and Services

The Services may contain links to third-party websites or services that are not operated by Theralinq, and the App is distributed through third-party platforms, including the Apple App Store and Google Play Store, each of which is governed by its own terms of service and privacy policy. This Policy does not apply to the practices of third parties, including Apple and Google. Theralinq also maintains business accounts on social media platforms, including LinkedIn, Instagram, and Facebook; your interactions with Theralinq on those platforms are subject to the respective platform’s privacy policy. We encourage you to review the privacy policies of any third-party services you access through or in connection with the Services. Theralinq is not responsible for the content or privacy practices of third-party websites or services.

12. Changes to This Policy

We reserve the right to modify or update this Policy at any time. If we make material changes, we will notify you by posting the updated Policy on the Website and within the App, and by updating the “Last Updated” date at the top of this Policy. For material changes that affect the processing of personal information, we will provide additional notice, such as an in-app notification or email to the address associated with your account, prior to the changes taking effect. Your continued use of the Services after the effective date of the revised Policy constitutes your acceptance of the changes. If you do not agree with the revised Policy, you should discontinue use of the Services.
